Please read below terms and conditions before you use our service.

 

1. Agreement to use our service.

1.1 Welcome to our website. If you continue to browse and use this website you are agreeing to comply with and be bound by the following terms and conditions of, use this website.

1.2 The term ‘TecSurgery’ or ‘our’ or ‘we’ refers to the owner of the website with registered office: 461 Lordship lane, London, N22 5DJ. The term ‘customer’ refers to the user or viewer of the website. The use of this website is subject to the following terms of use:

 

2. All repairs.

2.1 TecSurgery is not affiliated with manufacturers in any way and use of our service may void manufacturer’s warranty.

2.2 TecSurgery uses original and high-quality replacement parts for the repairs that offer same functionality but, in some cases, displays may have slightly different colour saturation or brightness.

2.3 We shall inform when the service has been completed and your device is ready for collection via email / phone unless we have agreed otherwise. 

2.4 Passcode of your device is needed in order to test it before and after the service. Should you prefer to keep this information private, we can still proceed with an appointment, but will not be able to perform a full functional check until you return to the store, which can delay the provision of the service, if any adjustments need to be made.

2.5 Time estimate given for completion of the service, is an estimate and does not form any obligation. We will aim to return your device within agreed time, however, if any complications arise (faulty replacement parts, additional problems with the device or device not passing tests), those may delay completion of the service.

2.6 Successfully completed repair cannot be cancelled or refunded.

2.7 Device withdrawn from ongoing repair is subject to service charge (diagnostic fee) to be paid. If the customer goes with the repair the diagnostic fee will be deducted from their actual repair cost. Phone diagnostic fee is £20, Tablet diagnostic fee is £30 and Laptop diagnostic fee is £40.

2.8 Diagnostic fee and water damage cleaning service shall always be paid upfront and is not refundable due to the nature of the service.

2.9 TecSurgery makes all reasonable efforts to repair your Device subject to the availability of any parts required and/or the terms of any relevant guarantee or warranty. We shall perform the Services using our utmost care and skill.

2.10 If we are unable to complete the Service for any reason, or the Service will incur further costs payable by you, we will notify you immediately.

2.11 All charges will be subject to all government taxes or duties as applicable.

2.12 The cost of repair will be calculated where possible in accordance with our standard charges as published from time to time.

2.13 We will keep your device until all charges payable have been paid.

2.14 We shall notify you when the Device has been repaired and is available for collection from store. If necessary, we shall send 2 reminders within 7 weeks period and if the device has not been collected by day 56, Tec Surgery will not be responsible for any equipment losses and reserves the right to dispose the device in order to recover the losses.  

3. Warranty.

3.2 The Warranty is linked to a specific device as identified by its unique IMEI or serial number and to a specific Customer as identified by the records on our system. It will cover the Customer for any reoccurrence of the original fault and for the part replaced / repaired only, however if additional faults arise, they will not be covered under the terms of this Warranty.  Furthermore, the Warranty will not cover accidental damage, nor will the cover extend should the device change ownership.

3.3 We do not accept responsibility for any progression in damage where your Device has been repaired elsewhere prior to your repair at Tec Surgery. Should any issues become evident, once the Device is opened, we will contact you via telephone/email.

3.4We do not accept responsibility for any progression in damage for Devices that have been damaged by liquid. Opening the Device could set off further damage which in some cases may be very serious and irreparable.

3.5 We ask our Customers to monitor their Device post liquid damage repair, as unknown issues can arise soon after treatment for liquid damage, which are beyond our control.

3.6 Should your Device display any further issues relating to the liquid damage during the Warranty period, we will re-assess and re-quote for the work needed. We will also offer a full refund of all monies paid by you with respect to repairs carried out to your Device, excluding the £20 diagnostic charge, should you wish to take this option.

3.7 Following repair, any water proofing or resistance cannot be guaranteed.

 

4. Liability.

4.1 Any data or information that you may have stored on the device shall remain your sole responsibility and we accept no liability for loss or corruption of such data however caused and we therefore highly recommend that you back up your device onto an external drive prior to your repair.

4.2 TecSurgery cannot guarantee restoring water proofing or resistance following the repair.

4.3 Some repairs involve risk of further damage that you will be notified before we start the service. By proceeding with the repair customer is taking full responsibility and agrees to pay for resolving any additional damages that may arise to the device during the service. If customer decides to cancel the repair without restoring consequential damages, the device will be returned not repaired and the damages may be visible. TecSurgery’s reputation shall not suffer in case of failed repair since we have mentioned about the risk in prior to the service.

4.4 If the device being checked in is non-responsive, not receiving power, or not powering on, Tec Surgery considers this device ineligible for device pre-check. By being ineligible for pre-check, we cannot be held responsible for what may be potentially broken along with what you may claim. By you signing this form, you sign an agreement with Tec Surgery stating you are authorizing us to do whatever is necessary to fix your device, possibly including but not limited to removing the device casing, motherboard, or small device components and cables.

4.5 Device that does not power on and comes from another repair service is considered by us as high-risk repair due to the fact it can be damaged by previous technician and we don’t know until we disassemble the device. Customer understands the fact that the condition inside the device is unconfirmed and we are not liable for any damages that we notice during the diagnostics. Customer will be informed immediately once we notice any physical / suspicious damages.

4.6 If your Device is damaged beyond economical repair as a direct result of a service or repair undertaken by Tec Surgery, you are entitled to a fully functional refurbished device of equal value to your Device, based on its model and condition as received and with the original repair issue resolved. In order to receive a replacement device, full payment must have been received for the repair service and the relevant damaged device must be surrendered to Tec Surgery.

4.7 In no circumstance shall we be liable to you for any indirect, special or consequential loss arising out of or in connection with this Agreement, including any loss of business, revenue, profits, anticipated saving, goodwill or any other indirect or consequential loss or damage of whatsoever nature howsoever arising.

4.8 Nothing in this clause shall apply so as to limit or exclude our liability for: (a) death or personal injury resulting from our negligence; (b) breach of any terms implied by statute; (c) any claim arising under the Consumer Protection Act 1987; or (d) fraudulent misrepresentation.

4.9 We shall not be liable for any claim arising under this Agreement unless you give us written notice of the claim within three (3) months of becoming aware of the circumstances giving rise to the claim or, if earlier, three (3) months from the time you ought reasonably to have become aware of such circumstances.

 

5. General.

5.1 We shall not be liable to you for any delay in or failure of performance of our obligations under this Agreement arising from any reason beyond our reasonable control.

5.2 Our failure to exercise or enforce our rights or the giving of any forbearance, delay or indulgence, will not be construed as a waiver of such rights under this Agreement or otherwise.

5.3 This Agreement sets out the entire agreement and understanding between you and us in connection with its subject matter. Nothing in this Agreement shall effect our liability in respect of any misrepresentation, warranty or condition that is made fraudulently.

5.4 This Agreement may not be amended, modified, varied or supplemented except in writing signed by or on behalf of you and us.

5.5 If any part of this Agreement is found to be void or unenforceable it will be severed from the rest of this Agreement so that it is effective to the extent that shall not effect the validity of the balance of the Agreement, which shall remain valid and enforceable according to its terms.

5.6 Nothing in this Agreement shall confer on any third party any benefits under the provisions of the Contracts (Rights of Third Parties) Act 1999.

5.7 This Agreement shall be governed by the laws of England and Wales and shall be subject to the exclusive jurisdiction of the English Courts.

 

6. Website terms & conditions.

6.1 The content of the pages of this website is for your general information and use only. It is subject to change without notice.

6.2 Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

6.3 Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.

6.4 This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

6.5 All trademarks reproduced in this website, which are not the property of, or licensed to the operator, are acknowledged on the website.

6.6 Unauthorized use of this website may give rise to a claim for damages and/or be a criminal offense.

6.7 From time to time this website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).

6.8 Your use of this website and any dispute arising out of such use of the website is subject to the laws of England, Scotland and Wales.

 

7. Refunds.

7.1 We offer 30 days refund policy on all orders including repair services that have not been started yet.

7.2 For online orders, if the device is already with us but we have not yet started the repair, you will be responsible for shipping costs back to you.

7.2 Any refunds will be processed with 7 days and you should get your money back within 14 days.

 

8. Not collected devices.

8.1 Any devices left at TecSurgery’s facility unclaimed or with overdue invoices for more than 56 days from creating the service ticket will be disposed without chance of getting them back and without compensation of any kind.

 

9. Data Protection.

9.1 We ask for your name and address and the other details so that we can provide you with updates about the repair and notify you when the service has been completed. By signing the T&C and using these services you consent to our use of your personal information as described. By signing the questionnaire and using these Services you consent to our use of your personal Information as described. If you do not wish to receive contact from us, simply email us on info@tecsurgery.com.

 

10. Indemnification.

10.1 You agree to indemnify, defend and hold harmless TecSurgery, its officers, directors, employees, agents, licensors, suppliers and any third-party information providers to the Service from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of this Agreement (including negligent or wrongful conduct) by you or any other person accessing the Service.
